The micro-enterprise revenue tax guide refers to companies that do not exceed one million euros in revenue under the micro taxation regime. If the threshold is exceeded during the year, the income tax classification is made starting with the quarter in which the threshold was exceeded.
Micro-enterprises are, according to the tax law, companies that on December 31 of the previous fiscal year meet the following conditions, cumulatively:
- revenue that does not exceed the equivalent in lei of 1,000,000 euros;
- the share capital is owned by a person other than the state and the administrative-territorial units;
- it is not in dissolution, followed by liquidation, registered in the trade register or in the courts, according to the law.

Mainly, companies that fall into this category pay either a 1% tax if they have one or more employees, or a 3% tax if they have none.
The calculation and payment of the income tax of micro-enterprises shall be made quarterly, until the 25th of the month following the quarter for which the tax is calculated. Micro-enterprises have the obligation to submit, by the deadline for payment of the tax, the income tax return of micro-enterprises – form 100.
Careful! If during a fiscal year a micro-enterprise generates revenues higher than 1,000,000 euros, it owes profit tax, starting with the quarter in which this limit was exceeded. In this situation, the calculation and payment of corporate income tax are made taking into account the income and expenses incurred starting with the respective quarter.
